Welcome to AIExamify ("we," "our," "us"), owned and operated by Techify Solutions Ltd, a company registered in England and Wales (Company number: 16515642). By accessing or using our website, mobile applications, or services (collectively, the “Platform”), you agree to these Terms of Service (“Terms”). If you do not agree, please do not use the Platform. These Terms form a legally binding agreement between you and Techify Solutions Ltd.

1. Acceptance of Terms

By registering, accessing, or using the Platform, including its lessons, quizzes, and AI-powered tools, you agree to be bound by these Terms and our Privacy Policy. These Terms apply to all users, including students, parents, and guardians.

2. Eligibility and Parental Consent

You must be at least 16 years old to use the Platform without parental consent. Users under 16 must have parental or guardian consent to use the Platform. By signing up or using the Platform, you confirm that you have obtained such consent if you are under 16. We reserve the right to suspend or terminate accounts of users under 16 if we determine consent is not provided.

3. Subscriptions and Payments

Subscriptions require payment of fees as listed on our pricing page. Payments are processed securely via Stripe. You may cancel subscriptions at any time through your account settings or by contacting us at aiexamify@gmail.com. Refunds are subject to our refund policy, available upon request.

4. Content Disclaimer

All content, including lessons and quizzes, is provided for educational purposes only. We strive for accuracy but do not guarantee that content is error-free, complete, current, or suitable for your specific educational needs. Reliance on content is at your own risk, and we are not liable for exam outcomes, academic performance, or other consequences.

5. AI-Generated Content Disclaimer

Lessons and other content generated by artificial intelligence are provided for educational purposes only. Due to the nature of AI technology, such content may contain errors, inaccuracies, or biases. We are not liable for any consequences arising from the use of AI-generated content.

6. Third-Party Content

The Platform may include third-party content, such as past examination papers. We do not claim ownership of this content and are not responsible for its accuracy, completeness, legality, or availability. Use of third-party content is at your own risk. External links on the Platform do not imply endorsement or affiliation.

7. User-Generated Content

If you upload content to the Platform, such as images for quiz grading, you represent and warrant that you own or have the necessary rights to upload and use the content, and that it does not infringe any third-party rights. By uploading content, you grant Techify Solutions Ltd a worldwide, non-exclusive, royalty-free license to use, reproduce, adapt, modify, distribute, and display the content for the purpose of providing the Platform’s services.

8. User Conduct

You agree not to:

• Use the Platform for unlawful purposes or to upload harmful, offensive, or infringing content.
• Attempt to access unauthorized areas of the Platform, hack, or disrupt its functionality.
• Share your account credentials or allow others to use your account.
• Engage in activities that violate applicable laws, regulations, or these Terms.

You are responsible for safeguarding your account credentials and any data you input.

9. Limitation of Liability

To the fullest extent permitted by law, Techify Solutions Ltd, its affiliates, officers, directors, employees, and licensors are not liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform, including but not limited to:

• Data loss or corruption
• Service interruptions, system failures, or downtimes
• Financial losses, missed opportunities, or academic setbacks
• Emotional distress, reputational harm, or personal injury
• Errors or inaccuracies in AI-generated or third-party content

This limitation applies regardless of the legal theory (contract, tort, negligence, or otherwise).

10. Indemnification

You agree to indemnify, defend, and hold harmless Techify Solutions Ltd, its affiliates, officers, directors, employees, and licensors from any claims, damages, losses, liabilities, or expenses (including reasonable legal fees) arising from your use of the Platform, violation of these Terms, or infringement of third-party rights, including intellectual property rights.

11. Data Breaches

We implement reasonable security measures to protect your data, but no system is immune to breaches. In the event of a data breach, we will notify affected users within 72 hours, as required by UK GDPR, and take immediate steps to mitigate harm. We are not liable for damages resulting from data breaches beyond our reasonable control.

12. System Failures

We strive to maintain reliable service but cannot guarantee uninterrupted access. We are not liable for damages caused by system failures, downtimes, technical issues, or unavailability of the Platform, including loss of access to lessons, quizzes, or user data.

13. Force Majeure

We are not liable for failures or delays due to events beyond our reasonable control, including but not limited to natural disasters, cyberattacks, government actions, third-party service disruptions, or internet outages.

14. Termination

We may suspend or terminate your access to the Platform at our sole discretion, with or without cause, including for violations of these Terms, non-payment, or suspected fraudulent activity, without liability. Upon termination, your right to use the Platform ceases, but provisions such as limitation of liability, indemnification, and dispute resolution survive.

15. Dispute Resolution and Arbitration

Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration administered by the London Court of International Arbitration (LCIA) under its rules. The arbitration shall take place in London, England, in English. You waive any right to participate in class actions, class arbitrations, or representative actions. The arbitrator’s decision is final and binding, subject to limited review as permitted by law.

16. Governing Law

These Terms are governed by the laws of England and Wales. Any legal action not subject to arbitration shall be brought exclusively in the courts of England and Wales.

17. Changes to Terms

We may update these Terms at any time without prior notice. Changes will be posted on this page with an updated “Last Updated” date. Continued use of the Platform constitutes acceptance of the revised Terms.

18. Warranty Disclaimer

The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or availability. We do not warrant that the Platform will be error-free, secure, or uninterrupted.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Techify Solutions Ltd, superseding any prior agreements or understandings, whether written or oral.

20. Severability

If any provision of these Terms is found invalid or unenforceable by a court of competent jurisdiction, the remaining provisions remain in full force and effect.

21. Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision unless explicitly acknowledged in writing.

22. Assignment

We may assign our rights and obligations under these Terms without your consent, including in the event of a business transfer. You may not assign your rights or obligations without our prior written consent.

23. No Third-Party Beneficiaries

These Terms do not confer any rights or benefits on third parties, except as expressly provided.

24. Compliance with Laws

You agree to comply with all applicable local, national, and international laws, including export control laws, when using the Platform. We are not liable for your failure to comply with such laws.
